BETWEEN (Party A):     Tourist(s)   AND (Party B):    China-eTours.com
1.     Reservation Terms:
     1.1   Phone Booking;
     1.2   Email Booking;
     1.3   On-line Booking;
     1.4   Off-line Booking;
     Remark: When the booking is confirmed, Party A will get a confirmation email or call from Party B, which includes the confirmed flights, hotels, and detailed itinerary and way of payment.
 
2.       Alteration of Itinerary:
     2.1       Alterations to your itinerary before the booking are happily processed free of  charge. Alterations after payment of the deposit will attract a fee of $25.00 per request. All expenses incurred by Party B in alteration of the booking are the responsibility of the customer. This includes all fees and charges levied by third parties such as cruise operators, airlines and hotels.
     2.2       Itinerary Change to the confirmed itinerary may happen because of traffic, weather, or any other conditions not under Party B's control such as war, strike, fire, acts of government, riot, etc. Party B will do the best to make sure that all the travel will be similar and can substitute the itinerary upon agreement of Party A.
 
3.       Travel Documentation:
All clients from Party A must be in possession of a valid passport and necessary visas or permits at the commencement of travel. All such documentation is the sole responsibility of the client. Party B may assist Party A applying for the necessary travel documentation upon request. Party B accepts no responsibility or liability whatsoever for the failure of clients to obtain appropriate documentation.
 
4.       Hotels:
The listed Hotels from Party B will be used according to the confirmed travel plan. When the confirmed hotels are not available, Party B can replace the hotels with the same standard.
 
5.       Transportation and Restaurants:
The cars, vans or coaches for the land transportation is in good shape with A/C. All restaurants are tidy and clean.
 
6.       Tour Guides:
All local tour guides are licensed and have minimum 2-year's tour guide experience at least.
 
7.       Quotation:
Tour cost is quoted for one traveler based on two sharing room, economic class domestic flight, all land transfers within China, luggage handling, hotels, three meals a day, sightseeing, tour guide service(or upon your request) in US Dollar. Party A can also disregard full package tours and choose whatever travel items. Usually travel insurance is not covered in quotations of Party B.
 
8.       Payment:
     8.1       Deposit & Final payment:
A deposit which is equal to 10% of the total tour cost is required at the time of booking. The full or final payment is required 30 days before departure for your China tour. Should the tour booked within 30 days before departure for your tour in China, full payment is required.
     8.2       Methods of Payment:
Party B only accepts the Wire transfer/Bank Transfer. Cash payment, travelers' check and company check is applicable upon special request, but personal checks cannot be accepted.

     8.4       Disclaimer of Difference Caused by Exchange Rate:
        8.4.1     Party B currently quotes tour prices in US Dollars.
        8.4.2     Should a revaluation of the Chinese local currency Renminbi occur, Party B will honor all quotations for tours that have been fully paid at the time of the revaluation.
        8.4.3     Party A who has not paid for their tour in full at the time of any revaluation will be required to pay the difference between the old and new price calculated in Renminbi. Party B will never charge more that our quotation that has been accepted by Party A.
 
9.       Cancellation Refunds:
In the event of cancellation, Party B will refund any payment (less any cancellation fee that is applicable) within 14 days of our receipt of your written cancellation request. The cancellation fee will be calculated as follows:
     9.1     Cancellation received more than 35 days before departure: 10% of tour price, but may be applied for your next trip within 18 months.
     9.2     Cancellation received from 21 to 35 days before departure: 10% of the tour price + full cost of Yangtze River Cruise if applicable.
     9.3     Cancellation received from 7 to 20 days before departure: 20% of the tour price + full cost of Yangtze River Cruise if applicable.
     9.4     Cancellation received from 3 to 6 days before departure: 50% of the tour price + full cost of Yangtze River Cruise if applicable.
     9.5     Cancellation received from 2 to 0 days before departure: 100% of the tour price + full cost of Yangtze River Cruise if applicable.
     9.6     No-show travelers will be charged 100% of the tour price full cost of Yangtze River Cruise if applicable.
     9.7     After the trip has commenced, Party B is unable to refund any amount for unused services due to willingness of tourist(s) of Party A, early departure, late arrival, or missed days on tours.
     9.8     Special Notes: The payment for the Yangtze River Cruise cannot be refunded if the cancellation notice is received less than 35 days prior to the date of the cruise.
     9.9     Party A need to pay more if the cancellation of a member in your tour group causes the change of the Tourist Class.
 
10.    Health Requirements:
Part A should take into account all international travel risks and familiarize themselves with health requirements applicable to the areas they intend to visit. Party A is solely responsible for checking the safety and security conditions, vaccination, and other health requirements of governments in countries visited or transited. Travelers to Tibet are required to provide a doctor's certificate stating that the he/she is fit to travel and his/her blood pressure and heart condition are normal. This is a necessary requirement because of the possible effects that the very high altitude may have on certain people.
 
11.    Luggage Allowance
In accordance with regulations of the General Administration of Civil Aviation of China, the free baggage allowance within China is 20kg for the economy class, 30kg for the business class, and 40kg for the first class, plus limited carry-on luggage. Excess baggage charges are the sole responsibility of the client. Regulations within China specify that all suitcases must have a locking device attached. Failure to follow this regulation may result in refusal by airport staff to load suitcases onto the aircraft.
 
12.     Insurance:
     12.1  Travel agency liability insurance:
Party A offers their clients the travel agency liability insurance. The travel agency liability insurance refers to the compensation offered to the travel agency by the insurance company because of travel agency's negligence or the error which has caused harm and damage to their clients. It is differ from the traveling accident insurance (personal insurance). "The travel agency liability insurance"mainly aims at the tourist loss and the injury caused by the travel agency responsibility, except by the force majeure, like the earthquake, the Tsunami and so on natural disaster bringing damage to tourist person and property, damage, which are not in its responsibility scope. Tourists suffering from the loss or the harm caused by their own diseases or tourist individual errors are also not in "travel agency liability insurance" in payment scope.
    12.2  Personal accident insurance:
Party A must inform their traveler to purchase his/her personal accident insurance from their native country before leaving for China. Therefore the tourist must protect oneself to apply for personal accident insurance.
 
13.    Complaints and Claims
In the event of a complaint or claim for compensation, Party A must inform us by email, regular mail, or facsimile in writing within 15 days from the end of tour. Relevant receipts and substantiating evidence must be attached to the letter of claim. Party B will not be liable for any claims made later than 15 days after the completion of your tour.
 
14.    Liability & Responsibility
     14.1    Party B shall not be liable for any loss, injury, or damage to person or property, alteration of itineraries or cancellation in part or in full, caused by climatic conditions, sea fire, breakdown of machinery or equipment, acts of government or other authorities, wars whether or not declared, civil disturbances, strikes, riots, thefts, epidemics, quarantines, medical or customs regulations, terrorist activities, or any other actions, omissions or conditions beyond Party B's control. Neither Party B nor any of its affiliates or subsidiaries shall be or become liable or responsible for any additional expenses of liability sustained or incurred by the tour member as a result of any of the aforementioned causes.
     14.2    Party B shall not be responsible for any wrongful or negligent or fraudulent, omissions, changes of itinerary, cancellation or the failure of any equipment operated by any suppliers such as transportation carriers, cruise, and hotels, or any other party not directly owned or controlled by Party B.
     14.3    Party B shall not be responsible for any wrongful or negligent acts, omissions, change of itinerary, cancellation or the failure of any equipment operated by any suppliers such as transportation carriers, cruise, and hotels, or any other party not directly owned or controlled by Party B.
     14.4    Party B is not responsible for a client's failure to comply with customs regulations.
     14.5    Party B is not responsible for the theft or lost of any customer's valuables or items of personal property due to the negligence of the customer.
     14.6    Party B reserves the right to substitute hotels, flights, or cruise ships, to alter itineraries, or to cancel the tour prior to departure. If Party A has cancelled any tour prior to the commencement of the tour, Party B is liable for a full refund of the money received by Party A.
     14.7    Many of Party B tour packages include activities which require care attention. Such activities include boarding and going ashore from boats, climbing hills and entering and exiting tombs and caves etc. Party A's tourists will receive help and advice from Party B's representatives but all activities are undertaken at your own risk. Party B, its employees and agents cannot be responsible for any action or event that occurs after its said employees and agents have exercised their duty and taken the necessary care.
 
15.   Arbitration Agreement:
Any problem or claim relative to Party A's travel shall be solved only in Beijing, China, on the basis of the terms in English.
